By accessing our website, using our services, or creating an account within The Bearded Marketer System (TBMS), you agree to be bound by these Terms. If you do not agree, do not use our services.

  • SaaS access via The Bearded Marketer System

  • Educational content, courses, and memberships

Services may be delivered via one-time engagements, recurring subscriptions, retainers, or software access.

 

3. Software Access (TBM System)

Access to The Bearded Marketer System is provided on a subscription or service-based basis.

You agree that:

  • Login credentials are confidential

  • You are responsible for all activity under your account

  • You may not resell, sublicense, or share access without written permission

We reserve the right to suspend or terminate access for violations of these Terms.

 

4. Payments, Billing, and Subscriptions

All fees are due as agreed at the time of purchase.

  • Payments are processed securely through third-party providers, including Stripe

  • Subscription services are billed on a recurring basis unless canceled

  • Failure to pay may result in suspension or termination of services

Unless otherwise stated, all payments are non-refundable.

 

5. No Guarantee of Results

Marketing outcomes vary based on numerous factors beyond our control.

We do not guarantee:

  • Specific revenue outcomes

  • Lead volume or conversion rates

  • Advertising performance

Results depend on market conditions, budget, implementation, and client participation.

 

6. Client Responsibilities

You agree to:

  • Provide accurate and timely information

  • Maintain compliance with applicable laws and platform policies

  • Use services ethically and lawfully

We are not responsible for delays or failures caused by missing information, third-party platforms, or client inaction.

 

7. Intellectual Property

All content, software, systems, workflows, designs, and materials provided by us remain the intellectual property of Guarisco Marketing, LLC, unless otherwise agreed in writing.

You may not copy, reproduce, distribute, or reverse engineer any part of our systems without permission.

 

8. Confidentiality

Both parties agree to keep confidential information private unless disclosure is required by law.

This includes business strategies, systems, credentials, and proprietary processes.

 

9. Termination

We reserve the right to terminate or suspend access to services or software at our discretion, including for:

  • Violation of these Terms

  • Abuse of systems or staff

  • Non-payment

Termination does not relieve payment obligations already incurred.

 

10. Limitation of Liability

To the maximum extent permitted by law, Guarisco Marketing, LLC shall not be liable for indirect, incidental, consequential, or special damages, including lost profits or data.

Our total liability shall not exceed the amount paid by you for services in the three (3) months preceding the claim.

 

11. Third-Party Services

We may integrate or recommend third-party platforms. We are not responsible for the performance, policies, or changes of third-party services.

 

12. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles.

 

13. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
